Terms of Service

1. Agreement Overview

Welcome to TrackingTCG. These Terms of Service (“Terms”) govern your access to and use of the TrackingTCG website at trackingtcg.com and all related services (collectively, the “Service”). The Service is operated from the Netherlands (“TrackingTCG,” “we,” “us,” or “our”).

By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service. You must be at least 13 years old to create an account.

2. Eligibility

Age requirement: You must be at least 13 years old to create an account. We do not ask for or store your date of birth; instead, we ask you to confirm that you meet this minimum age requirement.

Public sharing: Public collection profiles, public statistics, and any other public-by-URL features may expose your collection data to anyone with the URL. If you are under 16, you may enable these public-sharing features only with permission from your parent or guardian. Before public sharing is enabled, we ask you to confirm that you are 16 or older or that you have parent/guardian permission.

Legal capacity: If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.

Accurate information: You must provide accurate information when creating your account and keep it up to date. You may not impersonate another person or use someone else’s credentials.

One account per person: Each individual may maintain only one account. Creating multiple accounts to circumvent restrictions, bans, or subscription limits is prohibited.

3. Account Registration

How accounts work

TrackingTCG offers two ways to create an account:

  • Email & password: You register with your email address and a password you choose. You are responsible for keeping your password secure and confidential.
  • OAuth sign-in: You sign in with your existing Google or Discord account. When you do so, we receive basic profile information from your chosen provider (your name, email address, unique user ID, and profile picture).

Your account responsibilities

You are responsible for all activity that occurs under your account. You must:

  • Keep your login credentials secure (your password, or the Google/Discord account linked to your TrackingTCG account)
  • Notify us immediately at support@trackingtcg.com if you believe your account has been accessed without your authorisation
  • Not share your account with others or allow others to access the Service through your account

We are not liable for any loss or damage arising from unauthorised use of your account where you have failed to maintain the security of your login credentials.

4. Free and Premium Tiers

Free tier

TrackingTCG is currently provided free of charge. Free accounts have access to all generally available collection-tracking features. We reserve the right to modify the scope of the free tier at any time, with reasonable notice for any change that materially affects features you actively rely on.

Premium subscription (planned, not yet available)

Premium is not currently available. We are planning a paid subscription tier (“TrackingTCG Premium”) that will offer additional features alongside the free tier. No payment method is collected, and no charges are made, until Premium launches. Any prices, billing cycles, or feature lists shown elsewhere on the Service are illustrative previews of what Premium may look like and do not constitute an offer of contract.

When Premium becomes available, we will publish full subscription terms covering pricing, billing cycle, automatic renewal, cancellation, refunds, price changes, and your statutory rights as an EU consumer (including the 14-day right of withdrawal under Directive 2011/83/EU). Existing users will be notified at least 30 days before Premium goes live, and Premium will only apply to you if you affirmatively subscribe. Until Premium launches, no part of these Terms obliges you to pay for the Service.

5. What You Can and Cannot Do

Permitted use

You may use the Service to:

  • Track, catalogue, and manage your personal trading card collections
  • Browse card databases and reference information
  • Use the Service features as intended, for personal and non-commercial purposes

Prohibited activities

You agree not to:

  • Scrape, crawl, or automatically extract data from the Service using bots, scripts, or automated tools without our prior written consent
  • Reverse-engineer, decompile, or disassemble any part of the Service
  • Redistribute, resell, or commercially exploit data obtained from the Service, including but not limited to card databases, pricing information, or aggregate collection data
  • Interfere with or disrupt the Service, its servers, or connected networks
  • Circumvent any access controls, rate limits, feature restrictions, or security measures
  • Create multiple accounts to evade bans, subscription limits, or usage restrictions
  • Upload or transmit any content that is unlawful, harassing, defamatory, obscene, threatening, discriminatory, or that infringes the intellectual property rights of others
  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity
  • Use the Service for any illegal purpose or in violation of any applicable law or regulation
  • Attempt to gain unauthorised access to other users’ accounts, data, or any part of the Service not intended for you
  • Use the Service to provide investment advice or represent that card pricing information constitutes financial or investment guidance

6. Intellectual Property

TrackingTCG’s intellectual property

The Service — including its design, source code, underlying software, database structure, user interface, original text, graphics, and logos — is owned by TrackingTCG and protected by copyright, trademark, and other intellectual property laws. These Terms grant you no rights to our intellectual property except the limited right to use the Service as described herein.

The TrackingTCG name, logo, and brand elements belong to TrackingTCG. You may not use these marks without our prior written permission.

Third-party intellectual property

TrackingTCG displays card names, images, set information, and other content related to various trading card games. This content is the intellectual property of its respective owners and is used on TrackingTCG for informational and reference purposes only. See our Disclaimers page for detailed trademark and copyright attributions.

TrackingTCG is not affiliated with, endorsed by, sponsored by, or specifically approved by any trading card game publisher, including but not limited to The Pokémon Company International, Nintendo, Game Freak, or Creatures Inc.

Your content

You retain ownership of any content you create on the Service (such as your collection data, notes, and tags). By using the Service, you grant TrackingTCG a non-exclusive, worldwide, royalty-free licence to store, display, and process your content solely for the purpose of providing and improving the Service. This licence ends when you delete your content or your account.

We do not claim ownership of your collection data. When self-service export tools are available, you may export your collection data directly. You may also request a copy of your personal data or request deletion in accordance with our Privacy Policy.

7. Service Availability and Disclaimers

“As is” service

THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, TRACKINGTCG DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

  • The Service will be available at all times, uninterrupted, or error-free
  • Any data, including card information, pricing data, or set details, is accurate, complete, reliable, or current
  • The Service will meet your specific requirements
  • Defects will be corrected within any particular timeframe

Maintenance and downtime

We may suspend or restrict access to the Service at any time for maintenance, updates, security patches, or other operational reasons. We will endeavour to provide advance notice of planned downtime but are not obligated to do so.

Data accuracy

Card databases, pricing information, set lists, and other reference data displayed on the Service are provided for informational purposes only. You should not rely solely on information from TrackingTCG for purchasing, selling, or investment decisions. See our Disclaimers page for more information.

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW:

TrackingTCG, its directors, employees, partners, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising out of or related to your use of or inability to use the Service, regardless of the theory of liability and even if we have been advised of the possibility of such damages.

Our total aggregate liability for any claims arising from or related to these Terms or your use of the Service shall not exceed the greater of: (a) the total amount you have paid to TrackingTCG in the 12 months immediately preceding the event giving rise to the claim, or (b) €50.

Nothing in these Terms excludes or limits our liability for: (a) death or personal injury caused by our negligence, (b) fraud or fraudulent misrepresentation, or (c) any liability that cannot be excluded or limited under applicable Dutch or EU law.

If you are a consumer in the EU, you retain all mandatory consumer rights that cannot be waived by contract.

9. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the Netherlands, without regard to conflict of law principles.

Any disputes arising from or relating to these Terms or the Service shall be submitted to the exclusive jurisdiction of the competent courts in the Netherlands, unless mandatory consumer protection law in your country of residence provides otherwise.

For EU consumers: Under EU consumer protection law, you may also bring proceedings in the courts of your country of residence. The European Commission discontinued the former Online Dispute Resolution (ODR) platform on 20 July 2025. For current consumer redress information, you can visit the European Commission’s Consumer Redress in the EU website.

10. Dispute Resolution

Before initiating any formal legal proceedings, we encourage you to contact us at legal@trackingtcg.com to attempt to resolve the dispute informally. We will make good-faith efforts to address your concern within 30 days.

If informal resolution is unsuccessful, either party may pursue the remedies available under the governing law section above. We do not require mandatory arbitration.

11. Termination

Termination by you

You may stop using the Service and close your account at any time by contacting us at support@trackingtcg.com or using the account deletion feature in your settings.

Termination by us

We may suspend or terminate your account at any time, with or without notice, if:

  • You violate these Terms or any applicable law
  • You engage in any prohibited activity described above
  • Your use of the Service poses a security risk or could cause harm to other users or the Service
  • We are required to do so by law
  • We decide to discontinue the Service or any part of it

If we terminate your account for a reason other than your breach of these Terms, we will provide reasonable notice where possible. If a paid subscription is in force at that time, we will refund the unused portion of the current billing period on a pro-rata basis, in accordance with the subscription terms applicable to it.

Effect of termination

Upon termination, your right to use the Service ceases immediately. We will retain or delete your data in accordance with our Privacy Policy. Sections of these Terms that by their nature should survive termination will continue to apply, including: Intellectual Property, Limitation of Liability, Governing Law, and Disclaimers.

12. Changes to These Terms

We may modify these Terms from time to time. When we make changes:

  • Minor changes: We will update the “Last updated” date at the top of this page.
  • Material changes: We will notify you by email and/or through a prominent notice on the Service at least 30 days before the changes take effect.

Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms. If you disagree with a material change, you may delete your account — and cancel any paid subscription that may then be in force — before the changes take effect, without penalty.

13. Miscellaneous

Entire agreement: These Terms, together with our Privacy Policy, Cookie Policy, and Disclaimers page, constitute the entire agreement between you and TrackingTCG regarding the Service.

Severability: If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force.

No waiver: Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

Assignment: You may not assign or transfer your rights under these Terms without our consent. We may assign our rights and obligations under these Terms without restriction.

Force majeure: We are not liable for any failure or delay in performance resulting from causes beyond our reasonable control, including natural disasters, war, terrorism, labour disputes, government actions, power or internet failures, or third-party service outages.
